  • CGSO,

  • Housing Tribunal,
  • For insurance or banking issues, you should contact the appropriate ombudsman.

Debt rehabilitation in South Africa is designed to help people who are struggling to repay their debts. This process is guided by the National Credit Act (NCA) and involves working with a debt counsellor to create a manageable repayment plan. Here’s a simple breakdown of how it works:

Acknowledging the Problem: The first step is recognizing that you are over-indebted and need help. This means you’re struggling to meet your debt obligations and need a structured plan to get back on track.

Finding a Debt Counsellor: You’ll need to approach a registered debt counsellor. These professionals are trained to assist individuals in financial distress. You can find a list of registered counsellors on the National Credit Regulator's (NCR) website.

Assessment: The debt counsellor will assess your financial situation by looking at your income, living expenses, and total debt. They’ll determine if you are indeed over-indebted and qualify for debt review.

Debt Review: If you qualify, the debt counsellor will inform all your creditors and the credit bureaus that you are under debt review. This stops creditors from taking legal action against you while the process is ongoing.

Negotiation: The debt counsellor will negotiate with your creditors to reduce your monthly payments to an affordable level. They aim to extend the repayment period and possibly reduce the interest rates on your debts.

Repayment Plan: Once an agreement is reached, the debt counsellor will create a new repayment plan. You’ll make a single monthly payment to a Payment Distribution Agent (PDA), who will then distribute the funds to your various creditors according to the plan.

Sticking to the Plan: It’s crucial to stick to the repayment plan. Regular payments will gradually reduce your debt.

Completion: After successfully paying off your debts as per the plan, you’ll receive a clearance certificate. This certificate indicates that you are no longer over-indebted, and your credit record will be updated to reflect this positive change.
