TYPE OF LEGAL PRACTITIONER YOU USE.

The more complex the matter, the more professionals involved, but the vast majority of matters are dealt with by a lawyer, or a lawyer overseen by an attorney.

A lawyer is someone who operates in the legal profession and has a LLB degree. An attorney is also a lawyer, however in addition to their LLB degree they have also completed 2 years of articles and been admitted as an attorney by the High Court of South Africa.

Advocates and Attorneys are lawyers, however a lawyer is not necessarily an advocate or an Attorney. With your legal team you might also deal with consultants, legal secretaries or paralegals.

DEPOSITS

In most instances when a new case file is opened or a letter of engagement signed, a deposit will be requested. The value can vary drastically but are negotiable within reason. Here are some general expectations:

  • Private or Family matters, between R3000 and R5000
  • Small business matters, between R5000 and R15000
  • Larger corporates, R15000 and R30000

STARTING ESTIMATES FOR MATTERS IN COURT:

  • Small Claims Court. You should be able to engage directly and avoid legal costs.
  • Labour Court. From R15000+
  • Magistrates Court. From R25000+
  • High Court. Starting between R50000-R75000+
  • Supreme Court of Appeals. Starting from R150000+
  • Constitutional. Starting from R250000+

PRIVATE AND FAMILY MATTERS ESTIMATES

It is nearly impossible to offer an average for fees as there are so many types of services. When engaging a Legal practitioner expect no less than 2-3 hours of work to be charged. Do not be shy to ask upfront how many hours might be needed or if there is a set rate for the service required.

BUSINESS AND CORPORATE MATTERS ESTIMATES

It is hard to offer an average cost for commercial matters because the fee is determined on the business needs and those vary radically. Be prepared to settle at least 3-10 hours of a legal practitioner’s professional fee. Discuss estimates, hourly, per project and even retainer options.

EXTRA COSTS

Your legal practitioner will charge for their time and in house law firm services. There might be additional costs related to external or support services such as using a Sheriff, a Private Investigator or even something simple like travel fees. Please take every opportunity to discuss potential additional fees and you are within your rights to ask for an itemised account.
